1. Introduction

Thank you for deciding to use our services (which we will refer to as the “Services” or the “Platform”). The Terms of Service (which we will refer to as the “Terms”) set out the rules that will govern our business relationship with you. Please read these Terms carefully as they form a legally binding contract between you (“you”, “your”, “the user”, “user”) and lulublack.co.uk (referred to as “Lulu Black”, “the site”, “website”, “us”, “we”, “our”, “ours”).

By using or accessing Lulu Black Services, you agree to be bound by the Terms and our Privacy Policy, which is expressly incorporated herein.

Lulu Black reserves the right, at our sole discretion, to amend the Terms, in whole or in part, at any time without notice and with immediate effect. The current version of the Terms can be found on https://lulublack.co.uk/terms-of-service and the last modified date may be viewed at the top of the page. By continuing to use Lulu Black Services, you agree to the current version of the Terms. We encourage you to review the Terms periodically.

We reserve the right, at our sole discretion and without liability, to monitor, screen, refuse, remove, edit, transfer or block any Content or User from or within Lulu Black Services. For the avoidance of doubt, nothing in this clause assumes our liability or responsibility over and in relation to any such Content.

2. Definitions

In addition to the terms defined elsewhere herein, the following terms shall have the meaning ascribed to them in this section.

“Account” refers to a unique account owned by you and created for you.

“Bot” refers to an autonomous program on the internet or another network that can interact with systems or users.

“Profile” refers to a unique character profile created by you inside your account, to advertise your adult services.

“AI Creation” refers to all content and images generated, displayed, produced or made available with the use, support or assistance of AI Tools.

“AI Tools” refers to services, features, tools or functionalities integrated with or supported by artificial intelligence.

“Catfisher” refers to a person who creates a fake online identity to deceive others, typically to form a fake relationship for financial gain, blackmail, or emotional manipulation

“Content” refers to all information, data, content, messages, photos, videos, recordings, images, ideas and other materials created or uploaded by you, into your account and profile area.

“Free Will” refers to the ability of the user to make choices independently of external influences or prior causes, allowing for voluntary and uncoerced decisions.

“Scammer” refers to a person who creates an online identity to deceive others, typically to form a fake relationship for financial gain, blackmail, or emotional manipulation

“Sex Worker” refers to a person who provides sexual services in exchange for money.

“Subscription Period” refers to the period which an advertising subscription plan is in effect, from the date you make payment for the Subscription Plan.

“Subscription Plan” refers to a package or tier of advertising services which you have access to in exchange for a payment for the Subscription Period.

“Third Party” refers to anyone living or imagined who is not you.

“User Content” refers to all information, data, content, messages, photos, videos, recordings, images, ideas and other materials created or uploaded by you, into your account and profile area.

3. Interpretation

These Terms and any separate agreements whereby we provide you Services shall be governed by and construed in accordance with the laws of England & Wales and shall be subject to the non-exclusive jurisdiction of the courts of England & Wales.

The Terms, which incorporates our Privacy Policy, constitute the entire agreement between the Parties and supersedes all previous representations and correspondence between the Parties.

Lulu Black shall not be bound by any other term or condition proffered by you in any correspondence or document, regardless of whether we expressly object to such term or condition.

The Terms are in the English language, which prevails over any translations of it to other languages.

The headings and titles used in the Terms are for convenience only and shall not be considered in construing or interpreting the Terms.

The term “including” in the Terms shall be interpreted to mean “including but not limited to”.

4. Who Can Use The Service

As a User you are able to engage in the following activities which include:

creating an Account and Profile;
uploading Content and images;
activating different levels of advertising by choosing a tiered ‘Subscription Plan’.

Before becoming a User, you hereby represent and warrant that:

you are eighteen (18) years of age or older;
you are over the age of majority in your country of legal residence;
you are using the platform of your own Free Will;
you are at all times in compliance with any and all laws and regulations of any jurisdiction that may be applicable to you in respect of all activities conducted in relation to your use and conduct of Lulu Black services.

5. User Conduct

You acknowledge and agree that you, and not Lulu Black, are entirely responsible for ensuring all Content posted on the Platform adheres to these Terms.

You also agree that:

all images uploaded to your profile are of you, and have not been created using AI Tools;
all images uploaded to your profile have the copyright holder’s permission to do so (copyright is usually owned by the photographer);
you own all other intellectual property used on your Profile;
no third parties are featured in your images, content or Profile;
you will not upload any images to your profile that are sexual in nature, obscene, involve nudity, or images where sheer outfits imply nudity;
you will not use sexualised language anywhere on your profile; this includes fetish discussion or anything else that could be considered ‘obscene’;
you will not use any language that could be implied as ‘hate speech’ on your profile.

We do not expect you to use your real identity on your profile, but you agree that you are a real-life sex worker, not a Bot, AI Creation, Scammer or Catfisher.

If the platform is used in a manner that violates, or we suspect violates, the Terms in any way, we may at our sole discretion, but are not required to, suspend or terminate your account, disable your access to the site and/or take any steps that is deemed appropriate to address the situation.

6. Safety

You agree that you are responsible for maintaining the security and confidentiality of all details and activities of any Account you create on the Lulu Black Platform..

You agree to use a unique password, not used now or in the past on any other website or platform or service.

You agree to secure your Lulu Black Account using multi-factor authentication.

You agree and understand that no one working for Lulu Black will ever ask you for your Account password. You agree that you will never divulge your Account password to any third party.

You agree that any computer, laptop or device used to access your Account on the Lulu Black Platform has adequate and up-to-date anti-virus protection.

You agree that you will not:

use the Platform for any purpose that is illegal or prohibited in these Terms;
advertise these Services to any person under 18 and the age of majority in your country;
create multiple accounts;
use any robot, spider, crawler, scraper, or other automated means to interface with or access the Platform or extract other Users’ information;
upload viruses or other malicious code or otherwise compromise the security of the Platform;
post or transmit any communication designed to or intended to obtain password, account, or private information from any Lulu Black User;
not use or develop any third-party application that interacts with other Users’ content or the Platform without our written consent;
not use the Platform in a way that could interfere with, disrupt, negatively affect, or inhibit other users from fully enjoying the services, or that could damage, disable, overburden, or impair the functioning of the Platform;
not submit or transmit any content that is forbidden in these terms, libelous, defamatory, graphic violence, threats, obscene, abusive, offensive, hate speech, incitements of violence, profane, or that infringes on any copyright or other rights of any other person;
not post or transmit any communication promoting underage, non-consensual, or other illegal sexual themes, whether simulated or real;
not post or transmit any communication promoting the sexual exploitation of minor(s);
not post or transmit any communication promoting the sexual exploitation of any individual(s);
not sell, assign, or otherwise transfer your account;
not attempt to circumvent any content-filtering techniques we employ, or attempt to access areas or features of the Platform that you are not authorised to access;
not probe, scan, or test the vulnerability of our Platform or any system or network; and
not encourage or promote any activity that violates these Terms.

6. Service Availability

To the maximum extent permissible under applicable law, Lulu Black shall not, whether in contract, tort or otherwise, be liable for any loss of profit or revenues, loss of use of products or services, cost of capital, financial losses, loss of business opportunity, loss of reputation, loss of contract, failure to meet contractual commitments or deadlines, downtime costs, increased expense of operation, loss of or corruption of any data, or any direct, indirect, incidental, punitive, exemplary, special or consequential losses or damages of any kind whatsoever, whether it be arising from the Terms, your use or inability to use Lulu Black Services, and/or the combination of Lulu Black Services with any Third Party Services or other networks or systems.

We do not guarantee, represent or warranty that your use of our Service and Platform will be uninterrupted, timely, secure or error-free.

We do not warrant that the results that may be obtained from the use of the Service will be reliable.

You agree that from time to time we may remove the Service and Platform for indefinite periods of time or cancel the Service at any time, without notice to you.

You expressly agree that your use of, or inability to use, the Service and Platform is at your sole risk. The services delivered to you through the Platform are provided without any representation, warranties or guarantees, either express or implied.

7. Termination of Services

We reserve the right, at our sole discretion and determination, without liability and with immediate effect, to restrict functionality, suspend, terminate and/or delete your Account and any information within, your use of Lulu Black Services or take any other appropriate measure (for instance, blocking your IP address) for reasons including but not limited to any breach of these Terms.

Upon termination of your account, in accordance with our Privacy Policy, the platform will remove your profile and photos but we will keep data required for business operations such as but not limited to; verification information, payment information, support conversations, and audit history.

Unless expressly provided for by applicable law (see below), we have no obligation to provide refunds or pro-rata refunds in any instance.

8. Billing and Payments

The Service available to you will be based on your Subscription Plan, which is billed upfront for a 3 month period.

We reserve the right, at our sole discretion, to determine and amend the pricing structure for Lulu Black. Any alterations in pricing will come into effect when your next payment is due. We may make unique promotional offers to select customers and unless made to you, such offers will not apply to you or the Terms.

Any changes to a selected Subscription Plan such as an upgrade or downgrade, will only take effect after the end of the current Subscription Period.

Your Subscription Period expiry date cannot be altered or extended, for example if you take your Profile offline while travelling.

In the event of any non-payment of a Subscription Plan, you agree that your Account and access to the Service will be terminated immediately.

9. Cancellation & Refund Policy

You have a 14 day cooling-off period when purchasing a Subscription Plan on our Platform – this applies even though the Service starts immediately.

The 14-day cooling off period begins on the date your Profile becomes publicly visible on our website.

Cancellation requests should be sent to hello@lulublack.co.uk. Refunds made during the 14 day cooling-off period will be pro-rated to reflect the Service period used.

No refunds are offered, for any reason, after the 14 day cooling-off has passed.

10. Chargebacks

Chargebacks are issued on behalf of a customer from a Bank or Card Issuer; to reverse a charge that is believed to be fraudulent.

The site will be given the opportunity to contest the chargeback and is required to provide information on the User Account and services provided to the Bank and/or Card Issuer.

If a chargeback process has been initiated, we will permanently disable your associated Account and Profile.

Fees incurred during the chargeback process may be forwarded onto the User.

11. Copyright & Intellectual Property

We respect copyright and intellectual property rights. It is our policy to promptly respond to any claim that content posted on the platform infringes copyright or other intellectual property rights (“infringement”) of any person.

We will use reasonable efforts to investigate notices of alleged infringement and will take appropriate actions under applicable intellectual property laws and these terms where it believes infringement has occurred, including removing or disabling access to the content claimed to be infringing and/or terminating accounts and access to the platform.

To notify us of a possible infringement, you must submit your notice in writing to hello@lulublack.co.uk and include a detailed description of the alleged infringement.

12. Data Privacy

You agree to our collection and processing of your information in line with the Terms and our Privacy Policy as you use Lulu Black Services. Such information will include:

data collected automatically and/or in connection with the use of cookies and similar technologies;
information provided voluntarily as you use Lulu Black Services, including User Content.

You agree to our use of a third-party payment processor to process payments made for and in relation to Lulu Black Services. By submitting payment information such as your credit card details to us, you authorise the third-party payment processor to store such information and/or charge you as appropriate until your Account is deleted.

You authorise and agree to our use of non-personal, de-identified and/or aggregated data derived from the operation and use of Lulu Black Services, including but not limited to User Content and data associated with your Google Analytics and Google Search Console accounts, for our business and/or operating purposes such as:

to compile usage and performance information related to Lulu BLack Services;
to operate, improve, develop, support and evolve Lulu Black Services;
to develop and publish benchmarks and similar informational reports (such data shall only be disclosed externally in de-identified and aggregated form); and/or
for any other lawful purpose.

Lulu Black owns all rights, title and interest in such de-identified and/or aggregated data and any data derived therefrom and you agree that we have no obligation to provide you with any attribution.

All information in relation to your use of Lulu Black Services is collected and processed in accordance with our Privacy Policy. For more details on our processing of information and how you may exercise your rights to your information, please refer to our Privacy Policy.

13. Acceptance of Terms

TO AGREE TO THESE TERMS, YOU MUST BE OF LEGAL AGE IN YOUR JURISDICTION AND OVER THE AGE OF 18. BY USING THE SERVICES, YOU ARE AGREEING, ON BEHALF OF YOURSELF AND/OR THOSE YOU REPRESENT THAT THE SERVICES ARE BEING USED OF YOUR OWN FREE WILL, FREE OF ANY OUTSIDE PRESSURE AND THAT YOU WILL COMPLY WITH AND BE LEGALLY BOUND BY THESE TERMS AS WELL AS OUR PRIVACY POLICY AND ALL APPLICABLE LAWS. IF YOU, FOR YOURSELF OR ON BEHALF OF THOSE YOU REPRESENT, DO NOT AGREE TO ANY PROVISION OF THESE TERMS, YOU MUST, FOR YOURSELF AND ON BEHALF ANY SUCH PERSON(S), DISCONTINUE THE REGISTRATION PROCESS, DISCONTINUE YOUR USE OF THE SERVICES, AND, IF YOU ARE ALREADY REGISTERED, DELETE YOUR ACCOUNT.

14. Warranties and Disclaimer

You hereby represent and warrant that:

you are at all times in compliance with any and all laws and regulations of any jurisdiction that may be applicable to you in respect of all activities conducted in relation to your use and conduct of Lulu Black Services;
the creation of any Account was completed by a human and the information used to create any Account is accurate, complete and rightfully yours to use and you will maintain it as such at all times;
you have all the relevant rights and permissions to enter into the Terms and use Lulu Black Services;
you are not in violation of any laws, regulations and/or intellectual property rights or will cause Lulu Black to be in violation of such laws, regulations and/or intellectual property rights in respect of all User Content.

15. Entire Agreement

The failure of us to exercise or enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.

These Terms and any policies or operating rules posted by us on this site or in respect to The Service constitutes the entire agreement and understanding between you and us and govern your use of the Service, superseding any prior or contemporaneous agreements, communications and proposals, whether oral or written, between you and us (including, but not limited to, any prior versions of the Terms of Service).

Any ambiguities in the interpretation of these Terms of Service shall not be construed against the drafting party.
